Trademark Policy & Infringement Notification

Veneportal.com (the «Site») respects the intellectual property rights of others. This Trademark Policy outlines the procedure for brand owners to report suspected trademark infringement by users of our platform.
1. Prohibited Content
Users are strictly prohibited from posting content that infringes upon the valid trademark rights of others. This includes, but is not limited to:
- The sale of counterfeit goods (items bearing a trademark that is identical to, or substantially indistinguishable from, a registered trademark without authorization).
- Unauthorized use of a logo or brand name in a way that is likely to cause consumer confusion regarding the source or sponsorship of the goods/services.
2. How to Report Infringement
To file a notice of infringement, the trademark owner or their authorized agent (the «Complainant») must provide a written «Notice of Trademark Infringement» containing the following information:
- Contact Information: Full name, mailing address, telephone number, and email address.
- Trademark Details: The specific trademark(s) being infringed, the registration number(s), and the country/jurisdiction of registration.
- Location of Infringement: The specific URLs or Listing IDs of the content being reported.
- Good Faith Statement: A statement that you have a good faith belief that the use of the trademark in the manner complained of is not authorized by the trademark owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
- Signature: A physical or electronic signature of the Complainant.

3. Our Response Process
Upon receipt of a valid and complete Notice, veneportal.com will:
- Expeditiously remove or disable access to the allegedly infringing content.
- Notify the User who posted the content that a takedown has occurred.
- Log the Infringement as part of our Repeat Infringer Policy.
4. Repeat Infringer Policy
Veneportal.com reserves the right, in its sole discretion, to terminate the accounts of users who are found to be repeat infringers or who repeatedly post content that violates this policy.
5. Counter-Notifications
If a user believes their content was removed in error (e.g., they have a license or the use is «Fair Use»), they may submit a counter-notice to info@veneportal.com explaining their right to use the mark. Veneportal.com may, at its discretion, reinstate the content or advise the parties to resolve the matter legally.
